Why do I need a traffic lawyer?

If the State charged you with a traffic offense, then the most important thing you can do is hire a good traffic lawyer. Traffic cases have penalties that can impact your freedom, your driving privileges, and even raise your insurance premiums. Having an experienced traffic lawyer is important to getting the best possible resolution on your case. Usually, traffic lawyers charge very reasonable prices for traffic tickets because the cases only involve 1 to 3 court dates.

What can a traffic lawyer do for me?

Here are many, but not all, of the things that a traffic lawyer can do for your case:

  1. Appear at every one of your court dates;
  2. Communication with any of your family members (with your permission) on the pending matter;
  3. Thoroughly review the charging instrument to see if there are any defects or errors;

Why would I hire a traffic lawyer if I know that I am guilty?

Because there is more than one possible outcome to any traffic case! For example, the judge could sentence you to pay a fine of $75 fine or $10,000 fine. Secondly, you could have your driving privileges taken away for a year or not at all. Thirdly, you could do no jail time or 180 days (6 months). With so many possible outcomes, an investment in a traffic lawyer can have a significant difference in the outcome of your case.

Will I have to testify?

The decision of whether you should testify or not really comes down to the specific facts of your case. Making that decision will require a long, in-person meeting with your lawyer. In cases that where the incident is on video, there is less of a need for the defendant to testify. In cases where the State is suggesting one explanation, but the truth in another explanation, then there is a greater need for the defendant to testify.

How long will my case take?

As short or as long as it needs to for you to have the correct outcome! If on the first date you waive your rights, plead guilty, and are sentenced, then your case can take 1 day. If you are offered a dismissal upon you obtaining a driver’s license, then your case could take 3 months. But if you plan on going to trial and would like several pre-trial motions filed because mistakes were made in your case, then the case could last up to a year or more. Many factors go into how long a case lasts.

What should I do if I cannot afford a traffic lawyer?

I get it. Some people are in a very bad financial situation. If the case involves a possible jail sentence (i.e. misdemeanor or felony), then you need to rely on the public defender. Public Defenders are free lawyers for people in tough financial situations. Although they are often overworked and underpaid, they are your last line of defense between you and the State.

The more you can educate yourself on the law and procedures, the more you can assist your lawyer in your defense. Class X Felony Traffic Cases

The following offenses are all Class X traffic felonies. Generally, class X traffic felonies involve mandatory prison with a sentencing range of 6 to 30 years in the Illinois Department of Corrections. However, not all cases have that sentencing range (i.e. Aggravated Discharge of a firearm can have a higher sentencing range if someone was actually shot). Class 1 Felony Traffic Cases

The following offenses are all Class 1 traffic felonies. Generally, class 1 traffic felonies are probation-able. Some of the offenses on this list (i.e. your 5th DUI, Agg. DWLS/R), however, involve mandatory prison with a sentencing range of 4 to 15 years in the Illinois Department of Corrections. There are other circumstances that could also affect the sentence you receive on Class 1 felonies, like if you were on felony probation or if this was your second class 1 offense.

Class 2 Felony Traffic Cases

The following offenses are all Class 2 traffic felonies. Generally, class 2 felonies are probationable. Some of the offenses on this list, however, could involve mandatory prison with a sentencing range of 3 to 7 years in the Illinois Department of Corrections. Class 3 Felony Traffic Cases
