Class X Felony Theft Cases

The following offenses are all Class X felonies. Generally, class X felonies involve mandatory prison with a sentencing range of 6 to 30 years in the Illinois Department of Corrections. Class 1 Felony Theft Cases

The following offenses are all Class 1 felonies. Generally, class 1 felonies are probationable. Some of the offenses on this list, however, involve mandatory prison with a sentencing range of 4 to 15 years in the Illinois Department of Corrections. There are other circumstances that could also affect the sentence you receive on Class 1 felonies, like if you were on felony probation or if this was your second class 1 offense.

Class 2 Felony Theft Cases

The following offenses are all Class 2 felonies. Generally, class 2 felonies are probationable. Some of the offenses on this list, however, could involve mandatory prison with a sentencing range of 3 to 7 years in the Illinois Department of Corrections. Your sentencing range could be different based on the facts and circumstances of your case.

  • Burglary to Buildings – 720 ILCS 5/19-1(a)
  • Robbery – 720 ILCS 5/18-1(a)
  • Possession of a Stolen Motor Vehicle – 625 ILCS 5/4-103
  • Kidnapping – 720 ILCS 5/10-1
  • Disarming a Peace Officer (attempting to take an officer’s weapon) – 720 ILCS 5/31-1a(b)
  • Identity Theft ($2,000 to $10,000) – 720 ILCS 5/16-30(e)(1)(A)(iii)
  • Theft ($10,000 to $100,000) – 720 ILCS 5/16-1(b)(5)

Class 3 Felony Theft Cases

The following offenses are all Class 3 felonies. Generally, class 3 felonies are probationable. If sentenced to the Department of Corrections, the sentencing range of 2 to 5 years. Your sentencing range could be different based on the facts and circumstances of your case.

  • Burglary to Auto – 720 ILCS 5/19-1(b)
  • Forgery – 720 ILCS 5/17-3(a)
  • Retail Theft (Over $300) – 720 ILCS 5/16-25 (f)(3)
  • Theft from Person – 720 ILCS 5/16-1(b)(4)
  • Theft ($500-$10,000) – 720 ILCS 5/16-1(b)(4)
  • Identity Theft (Second Offense) – 720 ILCS 5/16-30(e)(1)(A)(i)
  • Identity Theft ($300 to $2,000) – 720 ILCS 5/16-30(e)(1)(A)(ii)
  • Aggravated Identity Theft (victim is 60+ or has a disability) – 720 ILCS 5/16-30(b)

Class 4 Felony Theft Cases

The following offenses are all Class 4 felonies. Class 4 felonies are probationable. If sentenced to the Department of Corrections, the sentencing range of 1 to 3 years. Your sentencing range could be 1 to 6 years based on the facts and circumstances of your case.

  • Identity Theft (Under $300) – 720 ILCS 5/16-30(a)
  • Theft (Second Offense) – 720 ILCS 5/16-1(b)(2)
  • Retail Theft
  • Possession of Burglary Tools – 720 ILCS 5/19-2(a)
  • Theft of Lost or Mislaid Property (Over $10,000) – 720 ILCS 5/16-2(d)(3)

Class A Misdemeanor Theft Cases

The following offenses are all Class A Misdemeanors. Class A Misdemeanors are supervision and probation eligible. However, you could be sentenced up to 364 in the county jail.

  • Bad Checks (Deceptive Practices) – 720 ILCS 5/17-1
  • Possession of Another’s Credit Card – 720 ILCS 5/17-32(a)
  • Theft – 720 ILCS 5/16-1
  • Possession of Stolen Property – 720 ILCS 5/16-1
  • Retail Theft
  • Theft of Lost or Mislaid Property ($500 to $10,000) – 720 ILCS 5/16-2(d)(2)

Class B Misdemeanor Theft Cases

The following offenses are all Class B Misdemeanors. Class B Misdemeanors are supervision and probation eligible. However, you could be sentenced up to 6 months in the county jail.

  • Theft of Lost or Mislaid Property (Under $500) – 720 ILCS 5/16-2(d)(1)
